Federal Law Mandates

Core COTPA 2003 Obligations

As an authorized B2B partner, you are legally bound to enforce these pillars of tobacco regulation at your respective points of sale.

Section 5: Advertising Ban

Total prohibition of direct or indirect advertisement, sponsorship, and promotion of tobacco products. Buyers must ensure that retail displays conform strictly to legal point-of-sale dimensions and do not constitute promotional marketing.

Section 6: Age & Proximity

Strict prohibition of sales to minors. While federal law mandates 18+, our corporate policy strictly restricts B2B purchases to individuals 21 years of age and older. Furthermore, sales are strictly prohibited within a radius of 100 yards of any educational institution.

Section 7: Packaging Standards

All supplied inventory is packaged with mandatory, government-approved pictorial health warnings covering precisely 85% of the principal display area. Altering, covering, or removing these labels is a severe federal offense.

Section 4: Public Smoking Bans

Prohibition of smoking in public places. While this primarily applies to end-consumers, our corporate partners operating physical storefronts must display appropriate statutory warnings and prohibit consumption on their commercial premises.

State-Level Variations

Tobacco legislation is a concurrent subject in India. Buyers assume total liability for complying with localized state variations, including dynamic tax structures, specific product bans (e.g., flavored products in certain states), and regional E-Way Bill transit requirements. Our compliance jurisdiction is centralized in Guwahati, Assam.

Zero Tolerance Policy

Any confirmed violation of COTPA 2003 or local state tobacco laws by a buyer will result in immediate termination of their B2B merchant account. The Company reserves the right to report non-compliant entities to state health departments and federal law enforcement agencies.
